New draft waits for EC’s approval
March 1 is the earliest date when the proposed new gambling legislation in Romania will be addressed again. The new draft was submitted in regards to the European Commission’s complaints concerning the July 2010 version, which was assessed as non-compliant with EU law.
Namely, the Commission’s rejection of the original draft implied that Romania could not pass the law without introducing the necessary changes into the new version of the bill. According to analysts, the original draft ran into the Commission’s disapproval because of:
* the discriminatory prohibition of marketing and advertising activities for EU licensed companies which are not authorised in Romania
* the requirement for EU licensed online betting companies to have their servers in Romania
* the requirement for EU licensed online companies to be established in Romania
* the unjustified exclusion of online pool betting while all other forms of online gambling would be allowed.
