Botswana is a land-locked nation located near the center of Africa. It borders South Africa to the south, Zimbabwe to the east and Namibia to the north and west.
It's unclear whether online gambling is legal in Botswana and which types of online gambling could be legal under or illegal under the current framework. Land-based casino gambling is completely regulated in Botswana, and they have a number of casinos in hotels. However, non-casino gambling is explicitly illegal. With that having been said, this raises a number of questions since online gambling is never specifically referenced.
One question is whether the law makes all online gambling illegal since it's not a part of land-based casino gambling. Another question is if it makes all online gambling illegal except for casino games. These aren't questions that are easily answered because no politicians or court cases have ever addressed it, but there have never been arrests or charges brought for any type of online gambling activities.
No licensing process is in place for online gambling in this country, but there are some indications that they might be open to the idea in the future. Because they have really embraced the land-based casino market, and because there are no laws explicitly making online gambling illegal by name, this leaves the door open for politicians to eventually embrace the Internet-based market as well. Whether or not this will happen any time soon is anyone's guess, but all of the necessary ingredients are there just waiting for someone to suggest online gambling for raising revenues.
In a situation like Botswana, it's easy to understand that there are no current levels of player protection in place for online gambling because there is no regulatory framework for it. However, if we look to how they handle the land-based casino industry, then we can make educated guesses at what types of protections are likely to be in place if they do eventually regulate the online side of the online gambling industry.
While their legal framework is set up to outlaw all other forms of gambling besides casinos, the player protections that exist inside of that framework for casino players are pretty outstanding. There is the equivalent of a control board that players can escalate complaints to. This bodes well for the hypothetical future of the online gambling industry in this country, but since it's not clear if online gambling is legal there, players are at their own risk for playing now or in the future.
