San Marino is a blue-level online gambling jurisdiction that purposefully has a lack of regulations regarding the industry.


In San Marino, they face a particularly interesting problem because of their exceptionally small size. With a population of fewer than 50,000 people, it would be difficult to regulate the industry and offer licenses. The simple fact of the matter is that they just don't have enough people in their country to make that a viable option.

Instead, they offer players the freedom to play with foreign operators instead of trying to lock down the industry in an irrational way. This is something that a number of other European countries could learn where we've seen some of them regulate the industry with absurdly high tax rates that provide incentives to keep reputable operators out. This is counter productive and hurts both the state and the players. With San Marino, they recognize the reality of the situation, and they use a policy that makes sense for their players.


At the time of this writing, San Marino has shown no interest in creating a licensing body for online gambling. However, if they were to do so, then it would be extremely difficult for them to get any operators or software countries to take a license unless they used a model similar to Malta or the Isle of Man where they provide oversight and favorable tax rates while allowing licensed companies to offer their services all over the world. That could be a viable option for them in the future, but they've shown no interest in it so far.

Player Protections

Since there are no licensed sites, and since San Marino does not have jurisdiction over the online gambling industry in other countries, players can't offer any real kind of player protections. With that having been said, they also do not go after players at all for enjoying foreign sites since they have no laws against it.

The best bet for players under this regime is to only stick with foreign operators that have a proven track record. This will prevent accidentally playing with shady businesses, and it will minimize the risk involved with online gambling in general.
